Terms of Service
These terms apply when you use JustAsk. By setting up a family or adding memories you agree to them. JustAsk is in preview — read section 4 carefully.
1. The service
JustAsk is a private memory companion for a person living with memory loss. Family members add memories; the person can ask about them on a screen and hear them back. JustAsk is part of AquaBrain.
2. Roles and who can use it
- You must be 18 or older to set up a family or add memories.
- The admin creates and manages a family with their own account. Family members add memories using a personal 4-digit PIN — keep your PIN to yourself. The patient uses a registered screen and signs in to nothing.
- Only set up a family for a person you care for or are authorised to support, and only invite people that person’s family trusts.
3. The memories you add
- The family owns the content. We claim no ownership of the memories added to a Brain.
- You grant us a narrow licence to store, process, speak aloud and display that content solely to operate the service for the family.
- You are responsible for what you add. Add only memories you are entitled to share about the patient, and nothing illegal or that infringes someone else’s rights. Please don’t add anything you would not want gently repeated back to the patient.
4. Preview status
JustAsk is in preview. That means:
- Features may change, break, or be removed without notice, and we may need to perform maintenance, including outages.
- The service is provided as is, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- JustAsk supports family care; it does not provide medical, clinical or emergency advice and is not a substitute for human care or professional help.
- The companion is designed to be gentle and to draw only on what the family adds, but it can be wrong or incomplete. Don’t rely on it for anything safety-critical.
5. Premium voice (bring-your-own-key)
- The premium voice option uses an ElevenLabs account you connect.
- You are responsible for the charges ElevenLabs bills you and for complying with their terms.
- We store your key encrypted and use it only to synthesize that family’s replies.
6. Acceptable use
You will not: attempt to reverse-engineer, scrape, or overload the service; use it to store or generate unlawful content; use it to harass, threaten or harm any person; try to access another family’s data; or resell or commercialise the service as your own product.
7. PINs and device tokens
Family PINs and patient device tokens are credentials. Anyone who has one can add memories or use a screen. Treat them like passwords; an admin can revoke or reissue them at any time, and we may revoke one if we believe it has been compromised.
8. Suspension and termination
- An admin may stop using the service and request deletion of a Brain at any time (see the Privacy Policy).
- We may suspend or terminate accounts that violate these terms or pose a security or legal risk.
- On termination, we will erase the content from primary storage within 7 days; backups roll off within 30 days.
9. Pricing
- JustAsk is $79 / year or $8 / month per family. One subscription covers the whole family, however many members add memories.
- During the preview there is nothing to pay. When billing is enabled it will be handled by Stripe; subscriptions renew automatically until cancelled, and cancellation takes effect at the end of the current period.
- We will give at least 30 days’ notice by email before changing the price of a plan you are subscribed to.
10. Limitation of liability
To the maximum extent permitted by law, JustAsk and its operator will not be liable for indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, revenue, data or use, arising out of or related to your use of the service. Our total liability for any claim is limited to the amount you have paid us in the 12 months preceding the claim, which during the preview is zero.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising out of the content you add, your use of the service in violation of these terms, or your violation of any law.
12. Changes to these terms
If we change these terms materially, we will email every admin with an active account before the change takes effect. Continued use after the change means you accept the new terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any dispute will be resolved in the courts of England and Wales, unless a mandatory consumer-protection law in your country gives you a different right.
